Professor Yang Feng publishes an academic paper in Legal Forum, a CLSCI journal, 2026

Recently, Professor Yang Feng and PhD candidate Zhou Jianchao have published an academic paper entitled The Theoretical Logic and Optimization of Formulation of Incentive Norms in Economic Law in Legal Forum, a source journal of CLSCI. The paper is featured on Pages 126-139 of the journal's 2026 Issue 1.

The paper points out that advocatory norms constitute an important type of norms in economic law and play a pivotal role in advancing economic and social development. Their emergence is directly associated with the governance philosophy and thinking of economic law, and they exert the functions of legal norms in interest coordination, value guidance and risk prevention. Classified by the criterion of legal consequences, incentive norms in economic law fall into two categories: encouraging norms without direct legal consequences and motivating norms with attached reward measures. Their logical structure consists of hypothetical conditions, behavioral patterns and legal consequences.

At present, incentive norms in China's economic law suffer from such defects as ambiguous definition of the subject of hypothetical conditions, too general behavioral models and vague legal consequences. To address these issues, it is necessary to optimize the norms by refining the expression of normative marker words, supplementing structural elements such as behavioral models and incentive measures, and improving the mechanism for the implementation of incentives. These efforts are intended to enhance the practical effectiveness of the norms and provide a theoretical paradigm and practical approach for the modern transformation of governance tools in economic law.
